Knowing what you are riding matters. Not every electric two-wheeler that looks like an e-bike is legally considered an electric bicycle.
According to the City of Austin’s September 2026 briefing on e-bike and e-moto regulation, an electric bicycle has:
The City notes that e-bikes are generally regulated as bicycles under Texas law.
That distinction matters because more powerful electric motorcycles and “e-motos” may look similar to an e-bike but fall under completely different operating, registration and licensing requirements.
Class 1: The motor provides assistance only while the rider is pedaling, with assistance ending at 20 mph.
Class 2: The motor may propel the bike without the rider pedaling, such as through a throttle, with assistance ending at 20 mph.
Class 3: The motor assists only while the rider is pedaling and can provide assistance up to 28 mph. Class 3 operators must be at least 15 years old.
For riders shopping for an electric bike in Austin, checking the motor rating, assisted top speed and class is more important than judging the bike by appearance alone.
Electric bicycles and electric motorcycles are not treated the same way.
The City of Austin briefing describes an e-moto as an electric two-wheeled vehicle that falls outside the legal e-bike definition, including a vehicle that lacks fully operable pedals, uses a motor rated at 750 watts or more, or has an assisted speed above 28 mph. These vehicles are considered motor vehicles rather than bicycles.
That means an e-moto used on public streets may require the same things expected of other motor vehicles, including appropriate registration, insurance and licensing. E-motos also cannot be operated on sidewalks or trails restricted to bicycle and pedestrian use.
The City’s main takeaway is simple: e-bikes are bicycles, while e-motos are motor vehicles.
This is especially worth knowing as increasingly powerful electric bikes and motorcycle-style electric vehicles enter the market.
In general, a qualifying e-bike can travel anywhere a traditional bicycle is permitted, with an important exception for certain natural-surface trails. The City briefing notes that municipalities may prohibit e-bikes on dirt trails where motor vehicles are prohibited.
Austin’s Urban Trails Program specifically states that e-bikes are allowed on Austin Urban Trails, while natural-surface trails are excluded. Riders should yield to pedestrians and keep their speed appropriate for shared trail use.
